Terms of Service

These Terms are a contract between you and Iter Travel App LLC (“Iter”, “we”), a New York limited liability company at 276 Fifth Avenue, Suite 704, PMB 70186, New York, NY 10001, USA. They govern the Iter app, the website at itertravelapp.net, and everything we provide through them (the “Service”). By creating an account or using the Service you accept these Terms and our Privacy Policy. If you do not accept them, do not use Iter.

1Who may use Iter

You must be at least 18 years old and able to enter a binding contract. You may not use Iter if you are in a country under US embargo or on a US government restricted-party list. Iter is offered in the countries listed on our website; using it elsewhere is at your own risk and some features may not work.

2Your account

One account per person, registered with accurate information. You are responsible for what happens under your login and for keeping your credentials private. Tell us at security@itertravelapp.net if you think your account has been compromised. You may delete your account at any time in Settings or at itertravelapp.net/delete-account.

3What Iter does

Iter builds a profile of your travel taste from your onboarding answers and how you use the app, and uses it to suggest destinations, generate itineraries and surface places and experiences. Suggestions and itineraries are produced with AI models. They may contain errors, omissions, outdated opening hours, wrong prices, or places that have closed. You are responsible for checking anything that matters before you rely on it.

Iter is not a travel agent, tour operator, airline, hotel or carrier. We do not provide travel advice, visa or entry guidance, safety assessments or insurance. You are responsible for your own passports, visas, vaccinations, insurance, entry requirements and compliance with local law.

4Bookings and partners

When you book a flight, hotel, experience or anything else, you leave Iter and contract directly with the partner: Viator for experiences, and airlines, hotel providers or booking services for flights and hotels. The partner’s terms, prices, taxes, fees, cancellation and refund rules and customer support apply. Iter is not a party to your booking, is not the merchant of record, and is not responsible for the partner’s performance, changes, cancellations or refunds.

Prices shown in Iter come from partners and third-party sources and may be indicative or out of date. The price at the partner’s checkout is the price you pay.

Iter earns a commission on some bookings made through partner links. Commission never affects which places, experiences or options we recommend or how they are ranked.

Some experiences may in future be bookable inside Iter through Viator; if so, Viator remains the seller and this Section still applies.

5Your content

You keep ownership of what you put into Iter: chat messages, trip details, itinerary edits and wishlists (“Your Content”). You grant Iter a worldwide, nonexclusive, royalty-free license to store, process, display and adapt Your Content to run the Service for you and to improve Iter’s recommendations and models, as described in the Privacy Policy. This license ends when you delete the content or your account, except for de-identified data and copies in backups for up to 30 days.

You confirm you have the right to share anything you put into Iter, including information about travel companions. Do not upload anything unlawful, infringing, hateful, sexual, harassing, or that facilitates harm to anyone, including any child sexual abuse material. We may remove content and suspend accounts that break this rule, without notice.

If you send us feedback or ideas, we may use them without obligation to you.

6Your Taste Profile

Your Taste Profile is yours. You can view, reset, export and delete it in Settings. Iter uses it only to serve you and to improve Iter; we do not sell it or share it with advertisers.

7Iter’s content and IP

The app, website, brand, design, software, models and all content we create are owned by Iter or its licensors. You get a personal, nontransferable, revocable license to use the app on devices you own or control. You may not copy, scrape, reverse-engineer, resell, sublicense or build a competing product from any part of the Service, or use automated means to access it. Trademarks remain ours.

Maps and place data come from Google and other providers. By using Iter you also agree to the Google Maps/Google Earth Additional Terms of Service and acknowledge Google’s Privacy Policy. Other attributions are listed in Settings › Legal › Attributions.

8Acceptable use

Do not use Iter to break the law, infringe rights, harass anyone, send spam, probe or overload our systems, or extract data or models. We may suspend or terminate accounts that do, and report unlawful conduct to authorities.

9Free service; future paid features

Iter is currently free. If we introduce paid features, we will publish their terms, prices, renewal and cancellation rules before you buy, and those terms will apply in addition to these.

10Beta and changes to the Service

Parts of Iter may be labeled beta or preview; they may change, break or be withdrawn. We may modify, suspend or discontinue any part of the Service. If we discontinue Iter we will give you a reasonable chance to export your data.

11Disclaimer of warranties

The Service is provided “as is” and “as available”. To the fullest extent the law allows, Iter disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, noninfringement, accuracy, and uninterrupted or error-free operation. We do not warrant any partner, place, experience or third-party service. Some jurisdictions do not allow these disclaimers, so some may not apply to you.

12Limitation of liability

To the fullest extent the law allows, Iter and its members, contractors, licensors and partners are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data, goodwill or travel costs, arising from the Service, any itinerary or recommendation, or any booking with a partner, even if advised of the possibility. Our total liability for all claims is limited to the greater of USD 100 or the amount you paid Iter in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by our negligence, or for fraud.

13Indemnity

You will defend and indemnify Iter and its members, contractors and licensors against claims, damages and costs, including reasonable attorneys’ fees, arising from Your Content, your bookings, your breach of these Terms or of any law, or your violation of anyone’s rights.

14Disputes: arbitration and class waiver

Talk to us first. Email legal@itertravelapp.net describing the problem. If we cannot resolve it within 60 days, either of us may start arbitration.

Arbitration. Any dispute between you and Iter, including whether this Section applies or is enforceable, will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, and the Federal Arbitration Act governs this Section. The arbitrator, not a court, decides all questions of scope, arbitrability and enforceability, except that only a court may decide the enforceability of the class-action waiver below. Arbitration will be conducted by video or on documents unless the arbitrator finds an in-person hearing necessary; any hearing takes place in New York County, New York. Iter will pay the filing fees for claims under USD 3,000 unless the arbitrator finds the claim frivolous or brought for an improper purpose, in which case the arbitrator may require you to reimburse Iter’s fees and costs. The arbitrator may award only individual relief and only to the extent a court could, and may not award damages that Section 12 excludes. The arbitration and its outcome are confidential except as needed to enforce the award. Either party may instead bring an individual claim in small-claims court.

No class actions. You and Iter agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class, consolidated or representative action, and the arbitrator may not consolidate claims or award relief to anyone other than the parties. If this waiver is found unenforceable for a particular claim, that claim goes to court and this Section 14 does not apply to it.

Opt out. You may reject this arbitration agreement by emailing legal@itertravelapp.net within 30 days of first accepting these Terms, stating your name, account email and that you opt out. Opting out does not affect any other Term.

Exceptions. Either party may seek an injunction in court to protect intellectual property or prevent unauthorized use of the Service. Nothing here removes rights you have under mandatory consumer law where you live.

Mass filings. If 25 or more similar claims are filed against Iter by the same or coordinated counsel, the claims will be grouped into batches of 25 and heard one batch at a time by one arbitrator per batch, with filing fees due only for the batch in progress; the parties will each choose 5 claims from the first batch to proceed as bellwethers, and any remaining claims are stayed until those bellwethers are decided. The statute of limitations is tolled while a claim is stayed.

Time limit. Any claim against Iter must be filed within one year after it arises, or it is permanently barred, to the extent the law allows.

Survival and severability. This Section survives termination of your account. If any part of it other than the class-action waiver is unenforceable, the rest still applies.

15Governing law and venue

These Terms are governed by the laws of the State of New York and the United States, without regard to conflict-of-law rules. For anything not subject to arbitration, you and Iter submit to the exclusive jurisdiction of the state and federal courts in New York County, New York, and waive any right to a jury trial. If you are a consumer in a country whose law gives you additional nonwaivable rights, those rights apply.

16Changes to these Terms

We may update these Terms. For material changes we will notify you in the app or by email and ask you to accept the new Terms before you continue; nonmaterial changes take effect when posted with a new effective date. If you do not accept updated Terms, stop using Iter and delete your account.

17Apple and Google

If you downloaded Iter from the Apple App Store, the following applies. These Terms are between you and Iter only, not Apple. Apple has no obligation to provide maintenance or support. Apple is not responsible for any warranty claim; to the extent a warranty applies and fails, you may notify Apple for a refund of the purchase price, if any, and Apple has no other warranty obligation. Apple is not responsible for product-liability, legal or regulatory claims or third-party IP claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not in a US-embargoed country or on a restricted-party list. You must also comply with any third-party terms applicable to your use of the app.

If you downloaded Iter from Google Play, these Terms are between you and Iter, and Google is not responsible for the app or its content.

18Electronic communications

You agree to receive notices, agreements and disclosures from Iter electronically, in the app or by email to the address on your account, and that they satisfy any legal requirement that communications be in writing.

19General

These Terms and the Privacy Policy are the entire agreement between you and Iter about the Service. If any part is unenforceable, the rest remains in force and the unenforceable part is reformed to the minimum extent needed. Our failure to enforce a Term is not a waiver. You may not assign these Terms; we may assign them to a successor or affiliate, including in a corporate reorganization, and will notify you. Section headings are for convenience only.
